Ok we have been in Europe for almost 3 yrs now and I had my son here. He is 2 yrs old. My husband cheats, lies, controls, mentally and emotionally abuses me, and is not a good father. I want to leave. I cant live like this. He never keeps a steady job and is a horrible person. Why should my son and I be bound to him for 16 yrs here bc the Hague convention prevents me from taking my son back home to the united states?? I am a good mother and i can give my son and I a much better life there. My husband threatens to not buy me food and to leave for days at a time if I confront him about the cheating. I am a prisoner and no one understands. I need help to get out but all the laws are in HIS favour! I dont know what to do! I have to type fast he is downstairs. I cant take him out of the country without my husbands permission and he wont permit it without him going to. So what if we all go on vacation and then i say we arent returning to europe? myson and i are american citizens and neither of us are european citizens NOR are we residents of any european county. my husband is though. if we all 3 go and then i stay with my son will my husband be able to take him back to europe? we are citizens,my son and i. please help me. i cant be a prisoner here much longer and my son is growing up with a horrible man for role model. i hope someone understands. Any ADVICE is welcomed. Thank you.
American embassies tend to NOT work in your favor in these situations.

I emailed several lawyers who specify in family law and international law and none have answered. That was 5 days ago.

I am wondering now if we ALL go back on vacation together and then I file for divorce while we are all in the US if I could start the custody fight and then it would be on him to stay there to fight for custody. Idk. If anyone knows advice will help. Im so desperate but not enough to kidnap my son and go to prison. I need to find a loophole somewhere. There has to be a way.

Consult an american attorney. I do believe though you can’t just take your son to america or that will be considered kidnapping. You will probably need a very good lawyer.

if someone has been together with a person for more than 18 years they are considered married, so their house is under both names and there is other property and two children 17 and 15 yrs old. What does the person that wants to file for divorce do in order to not lose the house who can she/he call for legal advice?

should make out police reports on her activities to protect himself and document everything that she does for the courts wihen the divorce happens in court

I live in California; no children; married for a little over 1 year now; I dred coming home from work; I dred being bothered about sex when I go to bed; I am seeing a therapist for the first visit on Thursday; my family does not like him; he doesn’t have assets; we don’t own anything together.

There is nothing invested in this marriage. Should I feel guilty about wanting to leave? What other things should I be thinking about while I am pondering what to do?
I married him too soon. He proposed 3 months after our first date and I was in a vulnerable place with a sister that just passed away 2 months previous. I do agree that I made a poor decision, but I’m not looking for a tounge-lashing… I’m looking for things to consider while I am working on TRYING to see if I can get the ‘spark’ back or not.

In the meantime, I know that I am being a really ugly person to him (not having any feelings for him, not wanting to spend time doing anything with him, being consumed that he has not held a job since we married… just all around, resenting him for everything!

I’m not the person he wished I was either… either before or after we married, but he thought it was still going to be okay and apparantly it’s not.
And, yes, I have talked with him about all this. It is not going to hit him out of the blue!

I need an advice I file for divorce on February 13 this year I finally found my husband in New York, he actually abandoned me with bills debt etc. He sign some paper of divorce except the financial he refuse to sign that part, if not they won’t give me the divorce from him. Get a lawyer and get out. There is no need for you to be financing his affair and lifestyle. Call a local divorce attorney and ask for some legal counseling.

i was mainly wanting to inquire about any divorce papers to be filed and where to send them. I didn’t even get to finish my entire message. Why did he sound like he was getting irritated and annoyed? And tells me to stop calling his phone but when I call again to finish my message he answers?

So if I am giving him what he wants…which may be what I want and finally see it’s for the best and tell him that, why is he getting defensive, being mean, and hostile?

I’m moving on in life in a very positive direction and am finally living and being the woman I know I was created to be. I’m also doing really well with BOTH our young children which he hasn’t seen in almost 2 years and hasn’t even given me a penny to help take care of.

He hasn’t file as of late.

Yes, we had problems like any other married couple, but he’s the one who made the choice to leave his family to be single again and basically free himself of what it takes to be responsible for a family.

There have been so many cruel things he has done not only to me, but while I was pregnant with both children.

Before I met him, I was so goal-oriented and made sure I did what I needed to do to get a job done. Then when we got married, it seemed like he never wanted me to do anything, he always wanted me in the house, etc…I’m sure a lot of you know how THAT goes.

Now, I have gone back to school and basically have the freedom that you need on a daily basis like drive myself somewhere and leave places when I’m ready to leave. BTW, he has had a history of domestic violence, but was never physically violent towards me.

He is 17 years my senior. I’m still in my mid 20s. Maybe the saying “things fall apart so better things can fall together” is true. I still have my whole life ahead of me and 2 beautiful kids to raise.

From a male’s perspective…what is going on and why is he acting that way?

He filed for divorce last Feb. but the case was dismissed. He didn’t even amend anything…just let it go.

And why hasn’t he filed for a divorce again if that’s what he really wants?

BTW, I’ve already filed child support last year, and he recently has been to court…no word yet regarding the outcome.
