Question by MoW39: Is it possible to file an uncontested divorce from the US if married in Alberta Canada to a Canadian resident?
I was married, but now want to get a divorce. My spouse is also fine with the uncontested divorce. Problem is, I am a U.S. resident living in Georgia and she is a Canadian resident living in Alberta. Can I file for divorce from here through the Canadian system or do I need to file in my current state of residency? Any advice would be great.

In the divorce papers submit that wife would like her name to be changed back. She needs to be written in the final divorce decree.

my wife and i have been married for 3 years now. she is disabled and no longer gets her money from the government because of the marriage. this makes it very difficult to pay the bills and put a little away for a rainy day.we have a thirteen year old boy and would like to be able to take him places and do things as a family but the money is too tight to be able to plan anything like this…we’re talking about getting a divorce so we can get her money back. what is the best route to go remembering there’s not much money to fork over for this situation……….please give input

If you do everything yourself … it will only cost filling fees … ask the county clerks office for help … they usually have the forms available ( or look up your county web site ) … good luck … !

I already finished :
1. Proof of service of summons
2. Certificate of Counsel

So what to do next? I’m so confused.
Next is: 1. Mail origianl, $ 335 check and 2 copies to the court and court will mail me back the stamped with copy of certificate of counsel
2. My friend take that copy of certificate of counsel to him to sign or he keeps that copy???
3. What’s next???

i did my own divorce here in calif. a few years ago, i went to the bookstore and bought a book called how to do your own divorce. it had forms and everything and was so simple to follow. also did u know that if your income is considered low that you can have the filing fee waived? go get this book….

Ok, I want to know what do you think ? my ex file for divorce but an UNCONTESTED DIVORCE, we decide that one because we do not have any kids and any asstes to share…and he said is the fastes one maybe in 2 month the divorce is finally…Now he came the other day to gave me the formal letter from the court were the grounds are abondoment..really i did not like the words sounds bad and actually i did not abandom the place actually he kick me out…and i leave or left… what do you think? about uncontested divorce plus abandoment ground…opinions

This is pretty cut and dry. My husband and I are trying to avoid using a lawyer. This is a mutual divorce. We own a home, have a few loans together, and own a car together. He deploys very soon, but is willing to pay the car payment, the loan payments, and the house payment while he is deployed. I told him I will take care of the house and sell it while he is gone. However–we are both confused. If we put in writing (and notarized) that he is willing to forward me 80% his entire check for bills ONLY during the deployment, will there be any issues? Will the lawyer consider it a joke? Like I said, it’s uncontested, and we have no issues. We just want to put in writing that I will receive 80% of his check only during the year he is gone.

Also, are we allowed to keep the car and house is both of our names? We plan to sell the home soon, but the car would be put solely into my name after deployment. Is this acceptable?

Annnd more….Do we really have to list all of our debts and bills in the papers if they are irrelevant?

Yes…I probably should get a lawyer, but we already know what we want and agree on it. Thanks in advance!

Base legal is FREE, go talk to them, have them write this up for you and file it in court. You can have them help you without having it become a legal battle in court, that way it is written up correctly.

my divorce is getting finalized Wednesday. Since my wife signed off on it, I’m the only one who needs to appear before the judge. My wife knows it’s imminent, and she’s ok with that, but as of right now she still doesn’t know exactly when this will take place. During the course of our separation we started talking again and agreed to salvage a friendship and we still care for one another. So my question is, when should I inform her of the finalization of our divorce? Should I tell her that day after it’s done or give her advance notice so she can brace herself? I know it will be a difficult day for her emotionally, so i’d like to make it as painless as possible for her. If any women could tell which u would personally prefer and why, I’d really appreciate it.

We divorced the same way. The paper were sent to me, I signed, and then they were stamped by the judge, there was a date on it that told me when I would again be an unmarried person. He never had to tell me…. it’s on the papers.
