Question by MNS: Does anyone know the steps needed in order to file a Bifurcation in a divorce case?
My initial divorce papers were filed about a year and a half ago. The final agreement was sent to my ex shortly thereafter. He signed them once and my lawyer led me to believe that they had been filed with the court. After three months of waiting, I finally called the court myself to learn that the papers had never been filed. When I asked my lawyer about this, he told me that he was missing paperwork and waiting for my ex to sign them. We have no property to split and I am not asking for alimony, I merely want to be divorced. Since neither my lawyer nor my ex is cooperating, I would like to file a Bifurcation to grant me my divorce. Any advice would be greatly appreciated. I do not want to have to file my taxes as “married” for another year. Not to mention the fact that we have been seperated for over two years and I would like to move on with my life!

Maybe you can file for contempt against your husband and file a grievance against your husband’s attorney for not filing the papers with the court.
Bifurcation means separating a case – which is not what you’re asking for:

Question by Cricket: Need to know benefit of divorce vs. separation for stay-home mom. Any advice?
After nearly 14 years of marriage, my husband has left me. I am a stay-home mom (6+ years now) with no immediate career prospects (although I intended to return to work soon anyway). Ex seems to think we should remain separated so that I can maintain my standard of living (within reason), but others feel I should move on to divorce and just get a good settlement.

i guess it is kind of up to u…. if u think that the seperation will work for ur situation… then so it…. u have to be legally seperated for so long anyway before a divorce can go through…. if u r that worried about it…. make sure u get child support for all of the children and then ask for alimony when it is all said and done…… good luck to u…?

Question by true friend: Did you know you can make someone mad by asking for christian advice in the marriage/divorce section?
Wow! I apologize for doing so. I am a Christian and proud of the fact. I didn’t intend for my question to come across rude but I guess that it did. I just want to know the right thing to do based from the stand point of CHRIST. If it offended anyone, I apologize but you didn’t have to reply.

Question by Happily Married: Husband wants a divorce if I don’t continue counseling sessions. Don’t know what to do. Advice?
My husband and me have been having communication issues. No cheating or drug issues. So, I managed to set up an appointment for me and him to get some counseling. Well, I supported him through his immature stage of putting friends first before his wife. He knows better now. I didn’t threaten divorce. However, I am starting to feel I need a small break from counseling to reflect on somethings. His response was I will divorce you if you do. What is that??? I almost don’t want to go to counseling because now it’s no longer about my want to stop counseling for a little bit, it’s now about him threatening me. So, if I continue to go it’s almost telling him “hey, your threat won. I am so scared I will do what you say.” He could have just spoken to me about his belief in the counseling not “I’ll divorce you speech. I didin’t do that to him. Advice how to handle this?

Keep going to counseling and work on your marriage if thats what you want to have. Otherwise I would say your husband should divorce your ass.
