Question by Alison L: Need family law legal advice please regarding house title in event of divorce or death?
My mother put down a huge downpayment for my husband and I to buy a home. The house is only in my and my husband’s names, so there is no proof that she gave us that money. We put in writing (a typed up 3 page document) that if we were to divorce or I die, that my mother becomes the owner of the house since she put 6 figures down on it. My husband signed it, and a girl at the bank notarized it-the last, third page of it anyway. If I were to die or we get divorced, will those papers that we created and signed hold up in court, or would we need a lawyer to draw up more official papers? Or is there something even better that we could do that I have not listed??

thank you for any advice!!

Best answer:

Answer by Doug
At the very least, you should have a lawyer review the document you signed to see if it will hold up under the circumstances that concern you.

ok so a while ago my mum and dad sat me down and told me that a few years ago my dad had had a relationship with another woman, it upsets me just to think about it. so they are getting seperated. but mum said they would stay civalised (for example they both came to my dance show last night). so i’m really not coping well with it, then i caught mum looking at a house on the internet and i liked it so she said that one day we might have to consider moving so i was up for looking at this house. it was okay but i wasnt thinking serriously. and now we’re looking at two houses and right now all the family are tidying the house so we can put it on the market after our holiday in 5 weeks. i know i will sound selfish, but i just want advice cos i’m breaking down. i LOVE LOVE LOVE my house, its a huge barn and my bedrooms gorgous, we have a lovley garden and its my home. the other houses we’ve been looking at look nice but i cant see myself living there. i dont want to move and neither does my brother. plus another problem is, we booked a holiday a year ago and my mum and dad are STILL both coming on it. is this weird? please just give me some words to help me :’(
thanks xxxxxxxxxxxxxx oh and i’m 14 <3

Question by Michelle Earey: Legal Advice Regarding Divorce (House Problems)?
I have filed for divorce last year, my wife refused to give me a divorce unless i said that i commited adultery which i did not do however i wanted to get out of this as quick as possible so i agreeded to sign. I have since found a new partner and i am living with her, my wife continued to live in the martial home for this year even though we have no children, i was paying all the mortgage and loan for the house. The house was then put on the market to be sold twice and everytime we had a deal go through she would pull out at the last minute saying she had no where to live. I then decided as the house was in negative equity to change it so that i would be left with the debt so i could get her to leave, she then agreeded to leave the house. However i have since found out for the last 6 months she has not been living at the martial home, and is in a partnership with my brother. What can i do to resolve this, i am with a solictor but dont feel i am getting the best advice for myself. As we were suposed to reach a settlement of when i could have half of our belonging and the key, so i could enter the property again, she has now removed all the belongings and still have not got the key i would be greatful for any advice you can give.
Just to repeat no children involved, and the property is in essex (uk)

Question by Holly S: advice on divorce, selling old house, buying a new one?
I am looking in to a divorce with my husband of 13 years.
we never had kids together, he has two from a previous marriage and I have one. All of our kids have children.

I live with him now and we have not yet started the conversation on what we will do. So far all we have come to say is that we both will try to make this as best for each other as possible.

What I need to know is how easy is it to still live with your intended ex until you both can save enough money for a down payment on other homes. We will be selling our house and will probably stay there together until it is sold, to save money.

Because we have refinanced last year we won’t have much equity to walk away from.

Anyone got any advice from personal experience?

thanks ?

Best answer:

Answer by DrPhilamina
It really depends on you guys. My ex didn’t move out for 6 months after we separated, due to his finances. We didn’t get along at all, it was HELL! However. we were much younger than you guys, we were 24 and 27 at the time, and have 2 small children. Maybe you guys are more mature than us LOL!

Just try to spend as little time at home as possible.

Question by Mickayla: my house burnt down on july 4th, and my parents are getting a divorce. advice please?
I’m 14 years old, a freshman now, here’s my story.

On july 3rd, my little brothers were playing in the backyard with fireworks, my oldest brother is 12 so my parents let him light the fireworks alone and with my other brothers. That afternoon, we left to go to our beach house for a 4th of july weekend vacation.

The next morning my mom started getting calls at like 7 in the morning and she didnt know any of the numbers so she ignored the calls. Soon after that, my mom’s good friend called her and told her to stay calm, because our house was on fire.

My mom was crying hysterically and my 3 younger brothers, 6, 9, and 12 years old, were in shock and so was I. So we hopped in the car to go back home, it was a 2 hour drive. We pulled up to our house and there were fire trucks and lots of people, my best friends were there and i ran to them and started sobbing as i watched the firefighters put out the last of the fire. We were told that the whole house burnt down and EVERYTHING was gone.

The firefighters investigated and told us that one of the fireworks my brother lit off, landed in a barkchip path and was smoldering all through the day and night. After the barkchips caught fire, they lit our ceder shed to flames which spread to our house.

As of right now, I moved to Portland and I’m going to a brand new high school without my best friends. I dont get along with anyone even half as good as i got along with my best friends

My parents are also going through a divorce right now and my mom recently met a guy on Facebook who lived in Ohio, then he flew out here to see her, and they slept together. It’s pretty fucked up.

My parents are making me go to counseling but i hate it and it doesnt help, it just reminds me of all the past i dont want to think about.

Now im never happy and i feel empty. Everyday i wake up thinking I’m in my old house, but im not.

And i’ve had extremely depressing dreams.

In one of my dreams, im with my best friends and they told me they had a surprise for me so they put a blindfold on me, and walked me somewhere. They took the blindfold off and around me were all of my friends, family, neighbors, and firefighters. One of my best friends said “it took a while, but this is for you and your family”. I was standing right in front of my house, but it looked like the fire never even happened. I walked up to the front door and opened it, to the right were our backpacks and shoes thrown in a messy pile on the floor. I slowly walked up the stairs while looking around at everything I had missed so much, everything that felt like home was all around me. I walked to my room and slowly opened the door. there were clothes all over the floor and it was messy, just like id left it. there was my makeup next to my mirror, my posters on the wall, and drawings and memories my best friends and i had made over the past few years that meant the world to me. I ran and jumped onto my messy bed, and buried myself into my pillows, and started crying because i was so happy.

Then i woke up, and ever since I’ve had that dream, it’s all i ever think about. I would give anything in the world to be able to go back into my room and jump on my bed.

I don’t know what to do or what to think, does anybody have any advice, or just anything to help me out?

Best answer:

Answer by speaker of unassailable truth
Um. When “house burnt down” and “divorce” appear in the same sentence, well, let me put it this way, you may want to delete this question.
