			<content:encoded><![CDATA[<p><strong><i>Question by MNS</i>: Does anyone know the steps needed in order to file a Bifurcation in a divorce case?</strong><br />
My initial divorce papers were filed about a year and a half ago. The final agreement was sent to my ex shortly thereafter. He signed them once and my lawyer led me to believe that they had been filed with the court. After three months of waiting, I finally called the court myself to learn that the papers had never been filed. When I asked my lawyer about this, he told me that he was missing paperwork and waiting for my ex to sign them. We have no property to split and I am not asking for alimony, I merely want to be divorced. Since neither my lawyer nor my ex is cooperating, I would like to file a Bifurcation to grant me my divorce. Any advice would be greatly appreciated. I do not want to have to file my taxes as &#8220;married&#8221; for another year. Not to mention the fact that we have been seperated for over two years and I would like to move on with my life!</p>

What would the procedure be for this?  Does she just need to go to a court house and get papers or does she need to hire a lawyer?  She doesn&#8217;t have a lot of money and she just wants this to be over with.  Any advice would be great.</p>

<p><i>Answer by Chico88</i><br/>In most states you will get the divorce granted for her failure to appear, BUT, no judge is going to finalize it until there is full documentation presented to the court detailing property and custody and/or a declaration of abandonment. Check with your lawyer. If you filed without a lawyer and there are kids and property involved you really need to hire one </p>

It will have all the paperwork you need and will walk you through the process step by step. Be careful, though &#8211; some judges don&#8217;t like for people to represent themselves and they&#8217;ll be on the lookout for any tiny little mistake you may have made in the paperwork or filing process!</p>

We&#8217;re from Florida, but we were married in Echols County, Georgia. Now, I am seeking to file for a divorce and I am wondering if I have to go back to Georgia to go through the process. Is there even a process? Or can I go down to the court house here in St. Augustine, Florida and file the papers. I&#8217;m trying to do this without a lawyer, we really have not acquired property/joint ownership of anything. I need some advice, thank you!</p>

<p>The process of seeking advice for an impending divorce is not an easy thing to do. Firstly, it is an admission to people that your relationship or marriage has failed and no one likes admitting to failure. Nevertheless, when a marriage has crumbled and both partners are looking for a way out, many times a divorce is the only recourse. In that case, whether you want to or not, you&#8217;ll have to begin seeking divorce advice.</p>
<p>The thing is, however, if you have never been thorough a divorce, where do you begin? For most people, the most logical place to begin is with your friends, especially divorced friends, if you have them. Your friend will empathize with you having gone through a similar experience herself. For similar reasons, a divorced friend will not look down on you, chastise you, or judge you.</p>
<p>Not only that, but a friend who has been had the misfortune to go through a similar divorce, will most likely have useful contact phone numbers that you can take advantage of &#8211; such as lawyers, accountant, counselors, and so on. But even beyond the practical reasons, a friend is a good person to seek advice from because they&#8217;re a shoulder to lean on.</p>
<p>Looking at things from a purely practical and legal standpoint, you will find that you will usually get the best divorce advice from a good divorce attorney. A competent divorce attorney knows the divorce rules of the state in which you reside and can help you to make the best legal decisions for yourself.</p>
<p>Most experts will probably advise you that, when you choose an attorney, don&#8217;t choose the same one as your spouse. This avoids possible conflicts of interest and ensures that the lawyer is primarily looking out for your interests as the divorce proceedings wind their way through the court system.</p>
<p>It is presumed that, by the time you have arrived at your decision to file for a divorce, that you have thought it through thoroughly and assured yourself that a divorce is the absolutely right thing to do. In the rare case, however, you decide at the last minute that you aren&#8217;t sure or that you want to change your mind &#8211; don&#8217;t go through with it just to avoid embarrassment.</p>
<p>But, even if the court proceedings have already started, you should not feel that you are compelled to follow through with the divorce no matter what. And, also, don&#8217;t let either of the lawyers intimidate you in going forward either, if you&#8217;ve had a true change of heart. The courts allow for the changing of one&#8217;s mind. Up until the divorce is final, you can back out at any time.</p>
<p>The most important thins is to come to the realization that divorce is not the answer to every problem in a marriage. As a consequence, it should probably never be the first option that you choose. The world is filled with long time married couples who had troubles at one point in their marriage, stuck with it, managed to resolve their problems, and ended up staying together as close friends and confidantes into their twilight years.</p>

I got on the family computer today to use Microsoft Word to type out an assignment.  My laptop unfortunately doesn&#8217;t have Word and this program you submit assignments through for this class only accepts Word.  After I opened it up, a notice popped up on the side saying it had recovered two documents, one of which was &#8220;Divorce Without Children.&#8221;  Now, I&#8217;m not a child, I&#8217;m 21 living at home for the moment to save more money for study abroad.  My little brother is 18 and in his senior year of high school.</p>
<p>I plan on studying abroad for the 2011-2012 academic year in Japan (this would span Sept. 2011 to July 2012 due to Japan&#8217;s academic calendar).  My little brother is presumably going to college.  Perhaps I should brace myself for things to be very different when I get back, right?</p>

Hello,  I want to get a divorce from my wife who is an active addict and our daughter is in CPS custody. She is happy where she is living and doesn&#8217;t want to live with me although I can see her whenever I want. How do I fill out the paperwork where it asks for the child plan? I can&#8217;t afford a lawyer right now.<br />

<p><i>Answer by Women_Kinda_Hater</i><br/>Go to Legal Assistance in your area.  They are there to help you file average court papers for little money.</p>
<p>By the way, don&#8217;t leave your daughter in the care of anyone else but yourself.  Whether or not she is &#8220;happy,&#8221; she is your daughter and you are responsible.  Unless you simply don&#8217;t love her enough, get your daughter!!!!!</p>
