Is it legal for the custodial parent (mother) to use a fraudulant last name for their child in school and when registering their child in organizations such as dance classes,athletic leagues,church,pagaents etc. against the non-custodial parents wishes? My husbands ex-wife is doing exactly this in our town.  She refuses to refer to their daughter by my husbands last name (which is on her birth certificate) even though he has talked to her many times on this issue and it is confusing there daughter who is 12. Does my husband have a legal right to stop her from doing this?<br />
This is to C_Bar: I did not think that the mother could change her childs last name unless the biological father gives up his rights to the child. My husband has weekend and holiday visitation with their daughter and faithfully pays child support and this woman is still giving their daughter her new husbands last name.</p>

<p><i>Answer by cyanne2ak</i><br/>Actually yes there are serious legal problems with it. You need to go see a lawyer right away. It can cause horrid problems for the children now AND in the future.</p>

<p>The judge listens solemnly then addresses Giuseppi.  &#8220;Giuseppi, isa dis true.You always a picka your nose and you never let Angelina on top? What you gotta say fora yourself?&#8221;</p>
<p>Giuseppi says, &#8220;Well your honor, itsa true.  I picka my nose a lot and, yeah, Angelina, I tella her she&#8217;sa  gotta be on da bottom.  Itsa all go&#8217;sa back to when I&#8217;ma young boy.  My poppa, he&#8217;sa very smarta man.  I always follow ev&#8217;ryting he say. My poppa one day he says, Giuseppi, I gotta tella you da two main secrets ofa hava successful life.  Number one, you always keepa your nose clean.  Ana number two, never screw up.</p>
