Question by Eva: Filing for divorce in a few days, please give me some advice?
I’m filing for divorce from verbally/mentally/emotionally abusive husband in a few days. Married 14 years, 2 children 8 and 6. Our house was foreclosed on, we live in a two bedroom apt. that is in his dad’s name( who can’t stand me), and I lost my job so I’m dependent on him until I get another (actively searching).
He is not abusive to our kids( of course other than hollering and degrading me in front of them which is bad enough), and he treats them better than he treats me. He has agreed to give me full legal and physical custody but he wants to see the kids. I don’t have a problem with that but i’m just wondering how this will work out. Is it better to agree in writing or what? and whaterver other advice you could give me as this is a trying time. I don’t know where my kids and I will move to because when i call the shelters they are full.
We could go over to my mom’s house but it’s not ideal but it’s ok. I’m just so frustrated.

Answer by Malamute Mom wow, definitely go to your moms if you can. Don’t put your kids in a shelter… and if you absolutely have to go there, let your children stay with their fatehr until you can get a steady job.

Question by venuslpn: Divorce Trial in 3 days… any last minute advice?
I initiated this divorce, we agree on everything except for custody of our children. I have always done MORE than 90% of all childcare, housework, etc. and work more hours than he does. When we moved out he started saying that he wants joint physical care, with a 50/50 time split, one week with him, one week with me. I have a lot of documentation, statements, etc. We went to court for temporary custody and I was awarded full primary physical care until trial. Just wanted to get any last minute advice. Anything I should avoid, besides the obvious (screaming matches, bad outfit, etc.)??? He’s got 8 witnesses lined up, including his parents, stepmother, sister, and both of the daycare providers we’ve had, even though I pay all the daycare, drop the kids off and pick them up every day. Any tips are appreciated. Anything you wish you could do differently in court? Also, do I ALWAYS address the Judge as “Your Honor” or is “Sir/Ma’am” acceptable as well?
I’m not a bitch in this I promise. I defend my still husband to my children all the time, even though he tells our 8 yr old daughter lies about me, trying to get her upset with me. Our son is 17 months. We tried the way he wants to do it for one month and my children were so confused they didn’t know what was up and down. I have a lawyer who is representing me, we’ve gone over what will happen in court, I am just asking for any experiences you all have had. He’s not a bad father, we’ve actually ADDED more time than the court put in the papers. All I want is for them to have a regular routine. They’d have a completely different schedule at his house, he doesn’t check my daughter’s homework on his nights and moved his mom in after I moved out to do all the cooking, cleaning and childcare that I previously provided. I don’t care about the money, the support he pays now doesn’t even pay my daycare bill. I just want what will give my children the most stable life.

Answer by D L You didn’t mention how old the children are or why your husband would need ‘witnesses’. You address a judge by his title with is name, or ‘your honor’. The judge will make the decision and hopefully in the best interest of both parents and for the children.
