He has started writing down instances when her outbursts occur (she’ll curse at their 8-year-old for nothing) and he wants the kid to live with him and for her to just get visitation after the divorce. What other steps should he take to make a better case for this? He feels it would be damaging for the child to live with her most of the time (plus, he’s very close to this child– it’s the only reason he’s stayed married this long). Any help, especially from a lawyer, would be appreciated.

Answer by Colleen O Just keep track of her verbal abuses and also in court go after child support. The fact that she is a woman/mother doesn’t mean the child does’t deserve child support.

She is happy where she is living and doesn’t want to live with me although I can see her whenever I want. How do I fill out the paperwork where it asks for the child plan? By the way, don’t leave your daughter in the care of anyone else but yourself. Whether or not she is “happy,” she is your daughter and you are responsible. Unless you simply don’t love her enough, get your daughter!!!!!

I do not want my child custody arrangements to be included in my divorce. The state is requiring it. What type of motion is best suited for this? Motion in limine? Motion to supress? I don’t know. Any advice?

Answer by STINEY Honestly, I think you’re screwed. If the children were born of the two of you while you were married, I’m 99% sure it has to be included. Unless you want to throw out ALL custody arrangements including child support, I don’t think you have a choice

A guy friend is getting a divorce. The ex asked him to come to her lawyer office so he can sign the papers. He asked her for a copy to be view on his own time to make sure what it says. She says he have no rights to get a copy and he have to sign and read the papers in front of her and her lawyer. Also have told him that she ready made a decision of being the primary parent to their daughter. He have no saying in it. Decision are made and he have no rights? Can anyone advice me what to tell him. He’s freaking out. He doesn’t have a lawyer…you guys know attorneys are expensive. The ex also said that if he wants to change anything in the paper and hires a lawyer he’s gonna have to pay her and his lawyer? Any advice?

My parents are going through a divorce. My mom does not have custody of me because she went to jail because I told my dad she abused me to get back at her for making me upset with a diferent situation with a family member. She was arrested now she lives with her mom and dad who threw us out of their house and lives last summer and wernt in any contact with us until 3 days after my moms arrest (new years eve) courts comming up and i want to live with my mom. idk if i can because of the abuse thing. but lately my mom and i havent had a very strong relationship as we used to. i feel im slipping away every visit. she seems more and more like a stranger. she had a few guy friends that my dad thinks were boyfriends shes been fighting for me but she doesnt spend hardly any time with me because of paperwork and searching for a job. i want to be with her but my dad doesnt want that for me. i have a boyfriend here at my dads that i would die to leave. i miss my mom and am more depressed everyday. i hate having to chose and i dont know where i want to go. no one is talking to me about the abuse thing which was a lie. idk what to do please help with any advice.

Answer by Common sense isn’t anymore.. So you lied about your mom and let her get ARRESTED and now you want to live with her? I sincerely hope she does not allow it. She needs to move on and try to regroup and get her life together after it was torn apart by YOU.
At any time you could have told the TRUTH and helped her, but you still choose not to. She should not have anything to do with you again in my opinon. I would write you off completely

reply by Maria B I think the main problem is that not everything needs to be answered, and I can not even imagine what $ 40K in 6 months. I have many cases of divorce where one spouse was instructed seen pay legal fees for the pair …. I want to go to court only the next time (you can call any time) and simpy account for the judge that you can not qualify for legal aid (but you have to go, they can not reject you, depending on the income of the spouse in a divorce case b / c you can not force him to pay the fees), and pay can not be avocat.Si he has a history of family violence must be a reason for which it more time to visit … not b / c you soon-to-be-ex has more money, said judges always the reason for this … You should write for that reason would ici.Je not the protection to be afraid, unless the man is actually trying to kill you … You have no position he can never actually make to that domestic violence is in many formes.Gardez because the drainage of money to a protective order to keep the room is a waste of money …. someone who really tried to hurt you … The order will be ignored anyway, and if he has a lot of money, chances are very low that he lose everything he has paid to end, your child prison.Focus risks.
