Ok we have been in Europe for almost 3 yrs now and I had my son here. He is 2 yrs old. My husband cheats, lies, controls, mentally and emotionally abuses me, and is not a good father. I want to leave. I cant live like this. He never keeps a steady job and is a horrible person. Why should my son and I be bound to him for 16 yrs here bc the Hague convention prevents me from taking my son back home to the united states?? I am a good mother and i can give my son and I a much better life there. My husband threatens to not buy me food and to leave for days at a time if I confront him about the cheating. I am a prisoner and no one understands. I need help to get out but all the laws are in HIS favour! I dont know what to do! I have to type fast he is downstairs. I cant take him out of the country without my husbands permission and he wont permit it without him going to. So what if we all go on vacation and then i say we arent returning to europe? myson and i are american citizens and neither of us are european citizens NOR are we residents of any european county. my husband is though. if we all 3 go and then i stay with my son will my husband be able to take him back to europe? we are citizens,my son and i. please help me. i cant be a prisoner here much longer and my son is growing up with a horrible man for role model. i hope someone understands. Any ADVICE is welcomed. Thank you.
American embassies tend to NOT work in your favor in these situations.

I emailed several lawyers who specify in family law and international law and none have answered. That was 5 days ago.

I am wondering now if we ALL go back on vacation together and then I file for divorce while we are all in the US if I could start the custody fight and then it would be on him to stay there to fight for custody. Idk. If anyone knows advice will help. Im so desperate but not enough to kidnap my son and go to prison. I need to find a loophole somewhere. There has to be a way.

Consult an american attorney. I do believe though you can’t just take your son to america or that will be considered kidnapping. You will probably need a very good lawyer.

Hello, I want to get a divorce from my wife who is an active addict and our daughter is in CPS custody. She is happy where she is living and doesn’t want to live with me although I can see her whenever I want. How do I fill out the paperwork where it asks for the child plan? I can’t afford a lawyer right now.

Go to Legal Assistance in your area. They are there to help you file average court papers for little money.

By the way, don’t leave your daughter in the care of anyone else but yourself. Whether or not she is “happy,” she is your daughter and you are responsible. Unless you simply don’t love her enough, get your daughter!!!!!

Hey so I’m a soon to be single stay at home mom with a 2 year old and 38 weeks pregnant. Baby could be due any day. I have no job and no money saved up as my husband has controlled all our money. What options do I have to get out on my own? I would like to get set up with HUD but don’t know if I can apply not having a job (waiting list is like a year) and I don’t know how to get child support if I don’t have money for a divorce. I’m not willing to move in with my parents under any circumstances as they have already said no. Are there any legitimate stay at home jobs? I just don’t know what to do next. I have no clue the first step of divorce or how to get out. Any help would be appreciated.

Why are your parents saying no? Are they hoping that it will force you to work on the marriage? Without more background on the circumstances its hard to give advice.

I do not want my child custody arrangements to be included in my divorce. The state is requiring it. What type of motion is best suited for this? Motion in limine? Motion to supress? I don’t know. Any advice?

Honestly, I think you’re screwed. If the children were born of the two of you while you were married, I’m 99% sure it has to be included. Unless you want to throw out ALL custody arrangements including child support, I don’t think you have a choice

A guy friend is getting a divorce. The ex asked him to come to her lawyer office so he can sign the papers. He asked her for a copy to be view on his own time to make sure what it says. She says he have no rights to get a copy and he have to sign and read the papers in front of her and her lawyer. Also have told him that she ready made a decision of being the primary parent to their daughter. He have no saying in it. Decision are made and he have no rights? Can anyone advice me what to tell him. He’s freaking out. He doesn’t have a lawyer…you guys know attorneys are expensive. The ex also said that if he wants to change anything in the paper and hires a lawyer he’s gonna have to pay her and his lawyer? Any advice?

Over 40 years old, can I really get help and assistant to go back to college as a divorce man paying child support for two children?

Situation: Filed for divorce in 2008. My divorce have been granted in October 2010 and have not yet been finalized. Pay child support for two children. I have one daughter 13 from the marriage and a one year old son out of marriage. I have over 15 years experience working in accounting. I have been living with my brother and his wife as I was basically homeless and was waiting for my divorce to be finalized. I’ve been working for one year on a temporary assignement which ended in Nov 2010. I am collecting unemployment and seeking full time work and looking to go back to college. I am seeking advice as to how to best stabilize myself with my responsibilities and to take charge of my education. I no longer want to neglect my education. I have strong knowledge as an accountant and realtor. I have a real estate license as well. Please advise.

Go to school. There is plenty of assistance for you. The guy I recently broke up with (long story) is 37 and going through a long and drawn out divorce including child support and alimony. His ex wife is taking everything she can…except his desire to grow as a man and make more of his life so that he can continue to support his 3 boys. He started going back to school last year. He makes a good living now, but sees his potential that he could make more with a degree and I am 137% behind him there. If you’re worried about financial aid, talk to an advisor at the college. He/she can tell you what is available in your situation. Do it.

i have given up everything i was going to school had to quite he was causing to many prolbems i had to quite my job and look for another one. i have a lawyer but i still feel like i Losing to him and I tired of giving in to him. He comes and goes as he pleases and yet I feel like I am a prisioner in my parents home any advice?

That’s your problem. You keep giving in to him. Stand up to him. Once he realize he can’t make you miserable he will move on.
Trust me I’ve been there.
