Pls Help Me -whether The Law Of Divorce Is Different In All The States Of India ?

My brother is staying in Maharashtra and His wife is from MP. The wedding took place before 3 years in MP. They have a baby of 1 yr old. They want to have divorce , as the marriage is not going very well. I want to know where can we register the case ? whether the rules are different in both the states ?

    Funny thing about this question is that rather then mentioning the religion of the parties & form of marriage you are asking the difference in the matrimonial law in different States of India (in this case M. P. & Maharashtra).
    The Matrimonial Acts such as Hindu Marriage Act,1955 have been enacted by the Union of India in the Parliament not by the States in the State legislatures. The only this which State enact is the Rules under the Main Act & that too is usually with regard to registration of marriage & other procedures etc or the State High Court enacts High Court Rules pertaining to the filling procedures of various Petitions/applications under the main Act. The basic law as provided in the Act is same anywhere in India.
    The Petition with regard to divorce/judicial separation etc can be filled at any of these places:-
    The District Court within the local limits of whose ordinary original civil jurisdiction:
    (i) the marriage was solemnized, or
    (ii) the respondent, at the time of the presentation of the petition, resides, or
    (iii) the parties to the marriage last resided together, or
    (iiia) in case the wife is the petitioner,where she is residing on the date of presentation of the petition, or
    (iv) the petitioner is residing at the time of the presentation of the petition, in a case where the respondent is at that time, residing outside the territories to which this Act extends, or has not been heard of as being alive for a period of seven years or more by those persons who would naturally have heard of him if he were alive.

    Think about the childs Life before going for divorce. Divorce is not the end of problems, its a new beginning of problem. Talk to you wife freely and accept her with you. think of the situation for your own sister. Be cool, think it over before u decide.
    Laws are the same.

    Hey, Before going for the divorce think about that kids life. Divorce is very ease. But what my suggestion is sit with the family people and talk and try to fix yourself instead going court
